The Americas – Argentina: The Ministry of Health already has a draft regulation for the Frontal Labeling Law

The Ministry of Health presented to food companies a draft of the regulation of the Front Labeling Law (Law 27.642). Minister Carla Vizzotti said that exemptions are considered for special cases in which it is not possible to meet the compliance deadlines, in other cases there is no flexibility in the times provided by law as companies want.

The meeting, led by Sandra Tirado of the Health Access Secretary, was attended by the Chief of Staff of the Ministry of Productive Development, Alejandro Sethman. The officials showed some details about the regulation, but without sharing any document.

The companies are requesting an extension of these implementation deadlines. The Law gives 180 days from the sanction for large companies to implement the black octagons.

The Americas – Mexico: Retained 380 thousand Kellogg’s products for non-compliance with the NOM-051 regulation on food labeling

Due to non-compliance with the labeling for prepackaged food and non-alcoholic beverages, the Federal Consumer Protection Office (Profeco in Spanish) immobilized more than 380,000 products, mainly Kellogg’s brand cereals, the agency reported. Profeco explained that together with the Federal Commission for the Protection against Sanitary Risks (Cofepris in Spanish) they carried out the first joint operation of the year to verify the correct application of NOM-051, related to food labeling to alert the population about the excessive content of nutrients in products.

The Americas – Venezuela: Front labeling guidelines for sugar, saturated fat and trans fat published

The purpose of the new Resolution (Nº 137 – Official Gazette 42.271) is to establish the guidelines that will complement the labeling of manufactured foods for human consumption, by placing a front label on the packaging label, in order to provide the final consumer with additional information about the sugar, saturated fat, and trans fat content in manufactured foods.

Manufactured foods with an added sugars, saturated fats and/or trans fats content added sugars, saturated fats and/or trans fats, equal or higher than the established, manufactured before the publication in the Official Gazette of this Resolution and during the first thirty-six (36) months after its publication, may be marketed until the expiration date thereof, using the labeling they have at the time of their distribution and commercialization.

The Americas – Brazil: Ministry of Justice suspends Carrefour’s “Nutri Choise” application

The Ministry of Justice and Public Safety (MJSP in Portuguese) decided to suspend the tool “Nutri Choice”, of the application “My Carrefour”, of Carrefour Brazil (CRFB3) regarding the classification and labeling of food.

The “Nutri Escolha” (‘Nutri Choice’, in free translation) function, a solution that works through algorithms and presents the customer with alternatives divided by criteria such as price and nutritional value.

The company has five business days, from the notification, to comply with the determination. After the deadline, if the tool is not removed, a daily fine of R$ 80 thousand will be applied.

The Americas – Brazil: ANVISA approves remote inspection of imported products

In addition to improving sanitary control and expediting inspections, the measure responds to the need to maintain social distance during the pandemic.

In practice, the measure will cover all imported goods and products subject to sanitary surveillance, being able to replace in-person inspection, at the discretion of the sanitary authority, in all types of imports. This means that consents will be carried out remotely by the Agency’s servers, but may also be carried out in person at stations installed at ports and airports, when necessary.
