Honduras – Draft Regulations of the Law for the Control and Regulation of Energy Drinks published

The Secretariat of Economic Development (SDE in Spanish) has published the draft Regulations of the Law for the Control and Regulation of Energy Drinks. This regulation aims to establish regulations for the sale and marketing of energy drinks and/or products, considering characteristics and specifications, in order to protect persons under eighteen (18) years of age. The Regulation is of general interest and of mandatory observance in the national territory and extends to all natural or legal persons engaged in any activity included in the supply chain, which includes: elaboration, handling, manufacturing, processing, packaging, storage, transportation, commercialization, sale, distribution, sale, importation; in addition to the promotion and advertising of beverages and/or energizing products with their characteristics and specifications.

Honduras – National Congress approves Law for the Control and Regulation of Energy Drinks

The National Congress has approved the Law for the Control and Regulation of Energy Drinks. The Health Regulation Agency (ARSA in Spanish) and the Health Commission of the National Congress jointly drafted the law that prohibits the commercialization of energy drinks for minors under 18 years of age. In addition, its sale in health, academic and sports establishments is prohibited.

With the approval of this law, the ARSA will regulate the access, sale, consumption, advertising and will implement the correct labeling to identify the dangers of the consumption of energy drinks.

In particular, the marketing of energy drinks to the general public is prohibited in the following establishments: educational centers at all levels, museums, sports facilities, day care centers, homes and other establishments intended for the care of children under 18 years of age.

The Americas – Costa Rica: New Procedures for the simplified sanitary registration of low-risk processed foods

The new Decree No. 43291-S establishes the procedure for simplified sanitary registration by notification, sanitary registration, registration acknowledgments, raw materials, control and surveillance of processed foods and low-risk cosmetics.

It is excluded in its scope of application:

  • Food products that despite being considered low risk present some nutritional descriptor.
  • Products specifically aimed at a population under 3 years of age.
  • Energy drinks and food supplements
  • Food or raw material containing any extract of the cannabis plant.
