Colombia – New draft resolution on sanitary conditions for the use of CBD in food intended for human consumption

The Ministry of Health and Social Protection (MSPS in Spanish) has issued a draft resolution that would establish the sanitary conditions for the use of Cannabidiol (CBD) in food intended for human consumption in Colombia. The main objective of the draft resolution is to guarantee food safety, product traceability and regulate its commercialization in the country.
According to the initiative, the regulation would apply to all persons and companies involved in the production, processing, distribution, commercialization, import and export of foods containing CBD.
Foods for special medical purposes, energy drinks, caffeinated products, as well as products intended for minors, pregnant or lactating women, will be out of scope.
One of the main provisions establishes that the maximum concentration of CBD in food must not exceed 1 mg per 100 grams of food or 100 ml of beverage. In addition, all products must follow strict good manufacturing practices -GMP-, guaranteeing the safety and control of THC levels, which cannot exceed 0.2%.
