Brasil – Proposed modification of the regulation on food supplements is under public consultation

The National Health Surveillance Agency ( ANVISA in Portuguese) has published Public Consultation no. 1,325, dated 04/17/2025 on the proposed amendment of the Resolution of the Collegiate Council – RDC that amends RDC no. 243, dated July 26, 2018, which provides for the sanitary requirements for food supplements, RDC no. No. 839, of December 14, 2023, which provides for safety testing and authorization of use of novel foods and novel ingredients and Normative Instruction – IN No. 28, of July 26, 2018, which establishes the lists of constituents, limits of use, declarations and supplementary labeling of food supplements.

Brasil – In consultation publishes regulations on the identity, purity and composition of ingredients authorized for use in food

The National Health Surveillance Agency (ANVISA in Portuguese) has published Public Consultation No 1324, dated 04/17/2025 – IN which establishes the identity, purity and composition of ingredients authorized for use in food.
It is necessary to regulate the specifications of identity, purity and composition of ingredients authorized for use in food, as part of item 3.8 of the Regulatory Agenda 2024/2025.

Argentina – Modification of the Argentine Food Code regarding the denomination of brown bread or whole wheat bread

Joint Resolution 19/2025 of the Secretariat of Health Management and the Secretariat of Agriculture, Livestock and Fisheries amends Article 735 of the Argentine Food Code,

ARTICLE 1.- Article 735 of Chapter IX, Farinaceous Foods of the Argentine Food Code is hereby replaced and shall be worded as follows: “Article 735: With the denomination of Black Bread or Wholemeal Bread, it is understood the product whose content, of the total of flours, is at least 50% of the wholemeal type.
This product shall be labeled: Black bread or Whole wheat bread.”

Costa Rica – Ministry of Health evaluates use of certain synthetic dyes in food products

The Ministry of Health announced that it is evaluating the use of certain synthetic dyes in food products, in accordance with recent decisions of the U.S. Food and Drug Administration (FDA). Against this backdrop, the Ministry calls on the food industry to review its formulas and consider natural coloring alternatives, in line with international public health best practices. It also informs that a technical process of revision of the authorized colorants in Costa Rica will be initiated, taking as a reference the recommendations and findings of international organizations such as CODEX and regulatory authorities such as the FDA and the EFSA (European Food Safety Authority), among others.

Argentina – Appeal filed with the Ministry of Health against changes in the front-end labeling law

The Inter-American Heart Foundation (FIC in Spanish), together with the Argentine Federation of Graduates in Nutrition (FAGRAN in Spanish), filed two appeals before the Ministry of Health to demand the suspension of the modifications to the front labeling law, implemented late last year by Milei’s administration.

“These modifications, published at the end of 2024 in the Official Gazette, introduce regressive changes that contradict the spirit of the law and directly affect the right of the population to access clear and truthful information about the products they consume”, stated from FIC.

The foundation maintains that “provisions 11362/2024 and 11378/2024” of the National Administration of Medicines, Food and Medical Technology (ANMAT in Spanish) “alarmingly weaken the Law for the Promotion of Healthy Food (PAS Law) and its regulations”.
