Argentina – ANMAT establishes requirements for health claims on packaged foods and beverages

The National Administration of Medicines, Food and Medical Technology (ANMAT in Spanish) has published Provision 8095/2023 which establishes the requirements for health claims on packaged foods and beverages.
The Provision establishes that the requirements established for the submission of proposed health claims to be presented to the competent health authority prior to the granting and/or updating of the National Food Product Register (RNPA in Spanish) for food and alcoholic beverages must be complied with.

  • The provision establishes that health claims may not be displayed:
  • Liquid and powdered preparations intended for infants, girls and boys.
  • Dietary supplements.
  • Foods for Specific Medical Purposes.
  • Packaged foods and beverages containing at least one warning seal.
  • Alcoholic beverages.

Peru – Congress approves gluten-free food labeling law

The Congress of the Republic approved the law that aims to provide information on gluten-free foods, so that consumers, especially those who suffer from celiac disease, intolerance or allergy to gluten, can make informed consumption decisions.

Law 31881 was published today in the Legal Norms bulletin of the Official Gazette El Peruano. According to the regulation, foods labeled as “gluten free” or “gluten free” must comply with the conditions set forth in the regulation of this law, which will be approved in the next 60 days.

Mexico – Senate unanimously approves the draft of the General Law on Adequate and Sustainable Food

The Senate approved a bill to enact the General Law on Adequate and Sustainable Food, which establishes the bases for the promotion, protection, respect and guarantee of the right to food.

The draft decree was approved, in general, with 98 votes in favor; and 95 votes in particular, so it was sent to the Chamber of Deputies for its corresponding procedure.

The Law prioritizes the rights to health, the environment, water, as well as the best interests of children, in the policies related to adequate food designed by the Mexican State.

Mexico – Decree banning trans fats in food and beverages in effect as of September 20

On September 20, the addition to Article 216 BIS of the General Health Law, which prohibits the use of partially hydrogenated oils and limits trans fats to 2 grams per 100 grams in industrial production, becomes effective.
The Decree prohibits foods, beverages, oils and edible fats from containing trans fats. The decree, approved at the beginning of the year, will be permanent and will affect the production line of multiple companies in the country.
