The Instituto Nacional de Vigilancia de Medicamentos y Alimentos (INVIMA in Spanish), informs that on February 8, 2024 ended the transitional period for the implementation of Resolution No 1407 of 2022 “Whereby the microbiological criteria to be met by food and beverages intended for human consumption are established”.
As of this date, natural or legal persons engaged in the manufacture, processing, preparation, packaging, storage, transportation, distribution, importation and marketing of food and beverages intended for human consumption must comply with the requirements established in this standard.

Brazil – IDEC’s request, the Justice determines that the industry must comply with the front warning label
El Tribunal Federal de São Paulo concedió una medida cautelar en la acción civil pública interpuesta por el Instituto Brasileño de Protección al Consumidor (IDEC) contra la Agencia Nacional de Vigilancia Sanitaria Anvisa (ANVISA) en relación con la ampliación de las instalaciones de la misma. Guatemala – National Food and Nutrition Security Policy updated 16 years after its first version
The Secretariat of Food and Nutritional Security (SESAN in Spanish) of the Presidency of the Republic, headed by Lizett Guzmán, led the updating of the National Food and Nutritional Security Policy (POLSAN) 2022-2037, which is a milestone as it is something that had never been done since its first version.
The POLSAN 2022-2037 establishes the guiding principles, thematic axes and guidelines to orient the country’s Food and Nutritional Security activities. Among its main updates is the rethinking of the target population, the redefinition of objectives, the focus on malnutrition – and not only malnutrition -, the emphasis on food systems and, in a cross-cutting manner, climate change.

Ecuador – Regulation on Food Waste Law has been published
The President of the Republic, Daniel Noboa, signed this January 19, 2024, the Executive Decree No. 120 with the regulations to implement the Law to prevent and reduce the loss and waste of food.
The law came into force in May 2022 but its regulations had not been issued. The regulation establishes the conditions in which processed food for donation must be found and their respective safety measures.

Peru – Executive Branch proposes to repeal the Law for the Promotion of Nutritional Supplements for Alternative Development
The Executive Branch proposed to repeal the Law for the Promotion of Nutritional Supplements for Alternative Development (Law 27821). With this objective, the central government submitted a bill to the Congress of the Republic that has been referred to the Agrarian and Health parliamentary commissions.
In the explanatory memorandum of the bill, it is stated that this law “has become irrelevant and ineffective”, and therefore it is proposed to repeal it. This will avoid “generating over-regulation of aspects that are already regulated”.
