ANVISA Amendment: Changes to Authorized Vegetable Species, Fats and Oils

The National Health Surveillance Agency (ANVISA in Portuguese) announces the amendment of Normative Instruction – IN No. 87, dated March 15, 2021, to Normative Instruction – IN No. 311. This amendment modifies the list of authorized vegetable species, the designations, the composition of fatty acids and the maximum values of acidity and peroxide value for vegetable oils and fats.

Argentina – Food Code amendment published on edible mushrooms

Through Joint Resolution 11/2024, the Secretariat of Health Quality and Bioeconomy Secretariat announces the amendment of Article 1249 of the Food Code on definition, classification and quality characteristics of edible mushrooms.

Brazil – The new regulatory framework that will improve pre-market control of foodstuffs based on risk criteria enters into force

The National Health Surveillance Agency (ANVISA in Portuguese) announces that as of September 1, new rules to regulate food in the country are already in force. The Resolution of the Collegiate Council (RDC) 843/2024 and the Normative Instruction (IN) 281/2024 introduce a new regulatory framework that will improve the control prior to the commercialization of food based on risk criteria.

The regulation came into force on September 1 and establishes three forms of food regularization:

  1. registration with Anvisa: products with mandatory registration, such as infant formulas and enteral nutrition formulas, will continue to require prior approval from the Agency. Diet therapy formula for inborn errors of metabolism was included in this group.
  2. Notification to Anvisa: foods considered intermediate risk, such as desalinated seawater, transitional foods, infant food cereals, recycled packaging and products with claims, can now be regularized by notification. This new form allows a more agile entry into the market, although companies must still provide information to Anvisa.

Argentina – Resolution approving the general framework for conformity assessment issued

Resolution 237/2024 approved the GENERAL CONFORMITY ASSESSMENT FRAMEWORK which, as Annex (IF-2024-92799306-APN-DNRT#MEC), is an integral part of this resolution, applicable to technical regulations issued within the scope of the SECRETARIAT OF INDUSTRY AND COMMERCE of the MINISTRY OF ECONOMY.

Peru – The process to approve the regulations of the law on the promotion of healthy eating for children and adolescents continues

The representative of UNICEP, Javier Álvarez, and María Elena Ugaz, Early Childhood Development and Nutrition Officer of the same institution, reaffirmed the importance of approving the new Regulation of Law 30021, Law for the Promotion of Healthy Nutrition for Children and Adolescents, which establishes the placement of the warning octagons of ‘High in sugars, sodium and saturated fats’, in formulas (or replacement milks) and baby foods according to the parameters of the Pan American Health Organization (PAHO).
The proposal is being reviewed by the Ministry of Economy and Finance, which must make it viable, stressing the need to speed up its approval.
