Brazil – New market access modalities according to type of food and supplement will come into effect as of September 1

The new regulatory framework for access (registration, notification and communication) to the market for supplements and foods, published by the National Health Surveillance Agency (ANVISA), will come into force as of September 1. According to the authority, RDC 843/2024 and Normative Instruction (IN) 281/2024 aim to improve the pre-marketing control of foods, based on risk criteria.

The measure reduces the administrative burden for both the regulatory agency and the food sector, in cases of lower risk; and maintains or increases the rigor, in the case of high-risk products or those with a history of complaints and denunciations.

The new rules define three forms of regularization. These are registration with ANVISA, notification to the agency and, finally, communication to local health surveillance bodies at the start of manufacture or import.

According to the regulatory framework for supplements, products with mandatory registration require ANVISA approval prior to marketing. In this group, infant formulas and enteral nutrition formulas were maintained, and diethotherapeutic formulas for inborn errors of metabolism were included.

For products considered intermediate risk, such as desalinated seawater, transitional foods and cereals for infant feeding, recycled packaging and foods with claims, registration was waived and a new form of regularization was created.

Argentina – CONAL publishes draft amendment to incorporate the 2 new mineral salts in supplements and fortified foods

The National Food Commission (CONAL in Spanish) has published a draft amendment to Article 1417 of the Argentine Food Code to incorporate the following mineral salts in supplements and fortified foods:

“21- FERRIC GLYCINATE.
Identification and purity as established in FCC, USP and other Pharmacopoeias. Use: as an ingredient in dietary supplements and fortified foods.”

“22- FERROUS GLYCINATE.
Identification and purity as stated in FCC, USP and other Pharmacopoeias. Use: as an ingredient in dietary supplements and fortified foods.”

Argentina – CONAL publishes draft amendment on fortified foods, beverages with added vitamins and/or minerals, powder for preparing added beverages and hydroelectrolyte supplements

The National Food Commission (CONAL in Spanish) has published a draft amendment to articles 1360, 1361, 1362 of the Argentine Food Code on fortified foods, Drinks added with vitamins and/or minerals, Powder to prepare an Added Drink and Hydroelectrolytic Supplement.

The main ones are:

  • Definition on fortified foods, Drinks added with vitamins and/or minerals, Powder to prepare Added Drink and Hydroelectrolytic Supplement.
  • The supply of vitamins and minerals
  • Quality specifications of the nutrients used.
  • Labeling requirements.

Chile – Ministry of Health publishes draft amendment to Food Sanitary Regulation on honey and natural syrups

Ministry of Health has published draft amendment to the Food Sanitary Regulation in Title XVII of the sugars and honey, paragraph II of the syrups and paragraph III of the honey, articles 391, 393, 393 BIS and 394 on the definition, types, identity and quality characteristics of honey and natural syrups. It also includes the definitions of corbicular pollen, royal jelly and honeydew honey.

Colombia – Ministry of Health publishes draft Resolution on sanitary requirements for canned tuna and tuna preparations

The Ministry of Health has published a draft Resolution that establishes the sanitary requirements to be met by canned tuna and tuna preparations manufactured, processed, packaged, stored, transported, imported and marketed in the national territory for human consumption.
